Optometric Education Society’s Policy for prevention of Sexual Harassment


The occurrence of sexual harassment in the workplace has been taken note of and the Hon’bleSupreme Court has laid down guidelines for its prevention and deterrence in 1997. In deference to the aforesaid guidelines, OES is committed to providing and promoting an atmosphere in which employees and students can realize their maximum potential in the workplace to maintain a safe, congenial, positive and productive working environment by making the workplace free from sexual harassment. All employees are responsible for ensuring that the workplace is free from sexual harassment. Because of Optometric Education Society’s (OES) strong disapproval of offensive or inappropriate sexual behaviour at work, all employees must avoid any action or conduct which could be viewed as sexual harassment.

Definition of Sexual Harassment

Sexual harassment includes unwelcome sexual advances, requests for sexual favours, and other verbal or physical conduct of a sexually harassing nature, when:

  1. Submission to the harassment is made either explicitly or implicitly a term or condition of employment or grades.
  2. Submission to or rejection of the harassment is used as the basis foremployment decisions affecting the individual; or
  3. The harassment has the purpose or effect of unreasonably interfering with an Individual’s work performance or creating an intimidating, hostile, or offensive working environment.

Sexual Harassment shall also include:

  • Unwelcome sexually determined behaviour (whether directly or by implication) in any form, such as:
  1. Physical contacts and advances
  2. A demand or a request for sexual favours
  3. Sexually coloured remarks
  4. Showing pornography
  5. Any other unwelcome physical, verbal/non‐verbal conduct of sexual nature.

This list is illustrative and not exhaustive.

Scope of the policy

The policy applies to all employees full and part time, consultants and students of Lotus College of Optometry, Unit of Optometric Education Society.

It is applicable on the College and Hospital Premises, outreach camps and well as visioncentres

All visitors and patients visiting our College or Hospital, or any of our vision centres and outreach camps

Sexual Harassment Investigative committee

OES has established a committee comprising of one managing trustee, Principal of Lotus College of Optometry and a Senior lecturer of College, who will jointly investigate the complaint.  

Reporting of Sexual Harassment

Any employee/student who has a complaint of sexual harassment at work by anyone, including supervisors, co-workers or visitors, should first clearly inform the harasser that his/herbehavior is offensive or unwelcome and request that the behavior stop. If the behaviorcontinues, the employee must immediately bring the matter to the attention of his/hersupervisor. If the immediate supervisor is involved in the harassing activity, the violationshould be reported to the Principal or a Managing Trustee.

Investigative Procedure and Confidentiality

The Committee commits to take prompt action by beginning the investigations. OES commits to keep all procedures and reports confidential till investigation is complete and will be provided only on a need to know basis.

All involved persons will be interviewed and within 10 working days an unbiased report will be prepared by atleast two members of Committee.

If the Committee decides that the matter is baseless, it may choose to close the matter with no action taken. However a report will be made and filed.

Committee if required is liable to give its opinion on the action to be taken and final decision will remain with the board of trustees of Optometric Education Society

If an employee is dissatisfied with the management’s response, they are free to contact the State department of Labor and Human Rights with his/complaint.
